Find Berkeley County Booking Photos

Berkeley County jail mugshots are handled through official custody and records channels, not through a county-run photo gallery. Find Berkeley County booking photos by checking the WV Regional Jail search and Daily Incarcerations first, then use a public-records request when a photo or report is not online. Berkeley County jail mugshots can be affected by release, transfer, dismissal, expungement, and West Virginia rules on law-enforcement social media posts. Booking photos should be read as arrest records, not proof of conviction.

Berkeley County Jail Mugshots Overview

The official place to check for a current Berkeley County booking photo is the WV Regional Jail search system or Daily Incarcerations page. The research notes that many West Virginia regional jail public records include booking photographs when a profile is available, but the captured official pages did not show a full live Berkeley County inmate profile. That means a Berkeley page should not promise that every search result has a mugshot field.

Eastern Regional Jail and Correctional Facility is the relevant public-facing jail for most adult Berkeley County state or local arrests. It is operated by WVDCR, not by the Berkeley County Sheriff's Office. When the roster does not show a photo, use official jail, court, or records channels. Commercial mugshot sites are not reliable sources for current custody, dismissed charges, acquittals, expungements, or release status.

Find Berkeley County Booking Photos

The lookup path starts with current jail custody. Use the regional jail offender search when the person's last name is known. Use Daily Incarcerations when the booking is recent or when browsing by county or institution makes more sense. If the person moved to state prison, use WVDCR prison search. If the arrest involved a federal or immigration matter, use BOP or ICE systems instead.

  1. Open the WV Regional Jail Offender Search.
  2. Enter at least the first three letters of the last name and add first name if known.
  3. Check Daily Incarcerations by county or institution when the booking is new.
  4. If no official photo appears, request the relevant report or photo through the proper law-enforcement records process.
  5. Use court records to learn whether the charge was filed, dismissed, amended, or resolved.

The official regional jail search is the starting point for current Berkeley County jail mugshot checks.

Berkeley County Mugshot Record Fields

No official live booking-photo profile was copied into the research file, so the safest inventory is limited to the verified public controls and notices. A full profile may include a booking photo or custody details when available, but exact photo placement, image count, demographic fields, housing fields, and release fields were not confirmed for a Berkeley sample.

Are Berkeley County Mugshots Public

West Virginia law does not turn every booking photo into a permanent public web post. W. Va. Code §62-1-6a governs booking photographs of criminal defendants and restricts law-enforcement social-media sharing for alleged minor offenses except in specific circumstances. Those exceptions include conviction, fugitive or imminent-threat determinations, or a court order finding a legitimate interest.

Key statutes:

W. Va. Code §62-1-6a defines booking photographs and limits certain law-enforcement social-media sharing and removal duties.

W. Va. Code §29B-1-3 gives access to public records unless an exemption applies.

W. Va. Code §29B-1-4 allows withholding or redaction for protected categories, including some law-enforcement records.

How Long Mugshots Stay Posted

The research did not locate a Berkeley-specific retention rule for how long a booking photo remains visible in the WV Regional Jail system after release. The official disclaimer says roster information is updated regularly and can change quickly. A photo may disappear because the person was released, transferred, the profile changed, or the record is no longer available through the same public path.

What is and is not public: Current jail lookup may show official custody information, but not every photo, report, or sealed detail is public. Court outcomes and records-request rules can change what may be released.

Request Berkeley County Booking Photo

If a booking photo is not online and the arresting agency was the Berkeley County Sheriff's Office, use the BCSO records process. The Sheriff's FOIA policy allows email, mail, and in-person requests. The report request form includes incident and crash report fields, report numbers if known, requestor details, and fee lines for photos, body or dash camera material, and reconstructed crash reports.

Request itemFee or channel from research
Incident, crash, or animal-control report$20 per report, paid at pickup according to BCSO services page.
Photo set up to 12$25 on the BCSO report request form.
Each additional photo set$25 per set.
Body or dash camera disc$50 per disc.
FOIA emailBCSOrecords@BerkeleyWV.org.

If the arresting agency was Martinsburg Police, West Virginia State Police, or another agency, the records request may need to go there instead of BCSO. Jail custody and arresting-agency records are not the same file.

Berkeley County Mugshot Removal

The West Virginia booking-photo statute creates a removal duty for certain law-enforcement social-media posts. If an agency shared a booking photo on social media, it must remove the photo within 14 days after a request by the person or authorized representative when the charge was dismissed, a grand jury declined indictment, an acquittal occurred, or a conviction was reversed, vacated, or nullified. That rule is narrower than deleting every booking photo from every database.

For court cleanup, use the expungement statutes and court process. W. Va. Code §61-11-25 and §61-11-26 govern certain non-conviction, deferred, diversion, and conviction expungement situations. A dismissal or expungement question belongs with court records after a jail arrest, not with a private mugshot-removal vendor.

Official Photos vs Mugshot Sites

Commercial mugshot sites should not be used as a source of truth for Berkeley County jail mugshots. They may scrape old images, leave up stale charges, omit dismissal or acquittal outcomes, and fail to show current custody status. Official custody systems, court records, and agency records requests are the reliable channels. Paying a private site does not change the court record or the official jail record.

When a photo or arrest record is wrong, outdated, or tied to a cleared charge, the practical route is official correction, court expungement, or the statutory removal process for qualifying law-enforcement social-media posts. Keep copies of case numbers, dismissal orders, acquittal entries, expungement orders, and agency correspondence.

Use the Berkeley County Sheriff's records process only for records that agency holds. A Martinsburg Police, state police, federal, or immigration arrest may require a different custodian.

State Federal ICE Booking Photos

The state prison locator is different from the jail roster. WVDCR prison search covers active WVDCR prison, parole, or supervision records and may be the right place after sentencing or transfer. The BOP locator generally shows federal identity, register number, age, race, sex, release date, and location fields. It does not provide the same county booking-photo route.

ICE ODLS is separate from both WVDCR and BOP. No official BOP prison or ICE detention center physically inside Berkeley County was located in the research. A federal warrant, U.S. Marshals matter, or ICE detainer can still affect a person's custody status even when the Berkeley County jail mugshot path does not answer the question.

Note: If custody status matters for safety, release planning, or victim notification, use official jail confirmation and West Virginia VINE rather than a photo search alone.
